Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GPU rental services provided by E3M d.o.o. ("Entrim", "we", "us"), including our website, console and on-demand bare-metal GPU servers (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it.
1.The Service
Entrim provides on-demand access to dedicated, bare-metal GPU compute — for example nodes built around NVIDIA GeForce RTX 5090 GPUs — hosted in data centres within the European Union. Compute is provided as rentable instances ("Instances" or "Nodes"). Availability depends on current capacity, and the specific configurations and pricing are those shown in the console at the time of order.
2.Eligibility & accounts
You must be at least 18 years old and have the legal capacity to enter into these Terms. You agree to provide accurate registration information and to keep it up to date.
You are responsible for safeguarding your account credentials, SSH keys and API tokens, and for all activity that occurs under your account. Notify us promptly at info@entrim.ai of any suspected unauthorised access.
3.Acceptable use
You agree not to use the Service, or allow anyone to use it, to:
- break any applicable law or regulation, or infringe the rights of others;
- develop, host or distribute malware, ransomware, botnets or command-and-control infrastructure;
- launch denial-of-service attacks, port scanning, intrusion attempts or other network abuse against any party;
- send spam, or conduct phishing, fraud or other deceptive activity;
- process, host or store child sexual abuse material or other illegal content;
- attempt to access, interfere with or compromise the underlying hardware, hypervisor, network, or the Instances or data of other customers;
- circumvent usage limits, billing or security controls, or resell or sub-let Instances without our written authorisation.
You are solely responsible for the software, datasets and models you run on your Instances, and for ensuring you hold the rights to use them.
4.Customer Content & your data
You retain all rights to the data, code, models and other content you upload to, store on or generate using your Instances ("Customer Content"). You are solely responsible for it, including for keeping your own backups.
Entrim does not access the content of your workloads except where strictly necessary to operate and secure the Service, to comply with law, or at your request for support. When an Instance is stopped and released, its local storage is securely wiped before it is reallocated.
5.Fees, billing & taxes
Use of the Service is charged according to the rates displayed in the console — typically per second of runtime at a per-GPU-hour rate, plus any storage or add-ons you select. Unless agreed otherwise, usage is billed in arrears on a postpaid monthly basis; reserved commitments are billed as set out at the time of order.
Payments are processed by our payment provider (Stripe), and you authorise us to charge your selected payment method. Fees are exclusive of VAT and other applicable taxes, which you are responsible for. Overdue amounts may lead to suspension or termination of the Service.
6.Availability & maintenance
We aim to keep the Service available and performant, but it is provided on a capacity-permitting basis and may be affected by maintenance, hardware failure or factors outside our control. Where reasonably possible we will give notice of planned maintenance. Unless you have a separate written service-level agreement, we do not guarantee any specific uptime or availability.
7.Suspension & termination
We may suspend or terminate your access to all or part of the Service, with or without notice, if you breach these Terms, fail to pay, or where necessary to protect the Service, other customers or third parties, or to comply with law. You may stop your Instances and close your account at any time. On termination, outstanding fees remain payable and your Customer Content and Instance storage are wiped.
8.Intellectual property
The Service — including our website, console and software, and all related intellectual property — remains the property of Entrim and its licensors. NVIDIA, GeForce and RTX are trademarks of NVIDIA Corporation; Entrim is not affiliated with or endorsed by NVIDIA.
9.Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.
10.Limitation of liability
To the maximum extent permitted by law, Entrim shall not be liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid to us in the thirty (30) days preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11.Indemnification
You agree to indemnify and hold Entrim harmless from claims, losses and expenses arising out of your use of the Service, your Customer Content, or your breach of these Terms.
12.Changes to the Service and Terms
We may modify the Service or these Terms from time to time. Where changes are material we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.
13.Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict-of-laws rules. The courts of Slovenia shall have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections that may apply to you.
